Radio Starlight — Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Radio Starlight and related services, websites, and content (collectively, the “Service”) provided by craftclay K.K., Oda, Mine city, Yamaguchi, 754-0211, Japan. By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Relationship to Apple’s Standard EULA. You selected the app from Apple’s App Store. The Apple Standard End User License Agreement (EULA) applies to your license to use the iOS/macOS/tvOS/watchOS app. These Terms supplement (and do not conflict with) Apple’s Standard EULA and the Usage Rules in the Apple Media Services Terms. If there is a conflict about license scope or device‑level usage, Apple’s Standard EULA controls; for Service features, content, models, data, subscriptions, publishing, and policies, these Terms control.

1) Key Definitions

  • Program / Segment — A show format you design; a segment may include prompts and source assignments.
  • Content Sources — External materials you connect (e.g., RSS/Atom/JSON feeds, APIs, public webpages).
  • Models — AI models you select (e.g., OpenAI, Google Gemini, Apple on‑device Foundation Models / Image Playground, or others you configure).
  • User Content — Content you provide or configure (prompts, personalities, uploads, presets, settings).
  • Generated Output — Content produced by Models via the Service.
  • Catalog Publishing — Optional publishing of Programs, Generated Output, source references, and assets using the Starlight Catalog Service open protocol.
  • Built‑in Sound Sets — Background music, stingers, and effects we provide inside the Service.

2) Accounts; Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of majority, you represent you have parental/guardian permission. If you use the Service on behalf of an organization, you represent you are authorized to bind that organization.


3) Third‑Party Services, Sources & Models

You choose which Content Sources and Models to connect. You are responsible for obtaining rights, permissions, and paying any applicable fees to those providers (including API usage, rate limits, and quotas). Third‑party terms apply to their content and services; we do not claim ownership of third‑party content accessible through your connections and are not responsible for it.


4) API Keys & Credentials

If you supply API keys or OAuth credentials, you authorize us to store and use them to operate the Service for you. You are responsible for all activity using your credentials and agree to revoke/rotate them if compromised. We may throttle or suspend integrations that threaten Service stability or security.


5) Programs, Segments & Generated Output

  • Your User Content. You retain rights to your User Content. You grant us a worldwide, royalty‑free license to host, cache, process, transmit, and display User Content and Generated Output as needed to operate, secure, and improve the Service.
  • Generated Output. As between you and us, you own Generated Output to the extent permitted by law and by the applicable Model provider’s terms. Generated Output may be similar to content generated for others or to public content.
  • Attribution & Licenses. The Service supports segment‑level attribution; you are responsible for honoring any attribution/license terms required by source owners and for verifying rights before distributing your shows.

6) Catalog Publishing (Open; Optional)

If you publish Programs, Generated Output, source references, personalities, or Sound Sets via the Starlight Catalog Service protocol: a) You choose the license (e.g., “all rights reserved,” Creative Commons) and represent you have rights to publish under that license; b) Published items and metadata may become public and remixable under the license you select; c) De‑publishing is prospective only—copies already accessed may continue under the original license; d) You agree not to include secrets or credentials in published packages.


7) Apple Music / MusicKit (Device‑Only Playback)

  1. No Apple Music rights granted. The Service does not grant any rights in Apple Music content. If you connect Apple Music, the Service may instruct Apple Music to play tracks on your device under Apple’s terms (which may limit use to personal, non‑commercial purposes).
  2. No capture or redistribution. The Service does not host, record, transmit, or redistribute Apple Music audio. You must not attempt to capture, re‑broadcast, or extract Apple Music audio via the Service.
  3. Exports & publishing are metadata‑only. Exports/published Programs or Broadcasts do not contain Apple Music audio. They may include metadata references (e.g., track title, artist, album, timecodes, links).
  4. User‑initiated; no gating/monetization. Apple Music playback is initiated by the user and is not monetized or gated (directly or indirectly) by in‑app purchases, ads, or data collection.
  5. Identity & artwork. Use Apple Music identity elements and artwork only in connection with playback UX and in line with Apple’s branding rules.

8) Sound Sets

8.1 Built‑in Sound Sets (Radio Starlight Originals)

We grant you a worldwide, royalty‑free, non‑exclusive, perpetual license to:

  • Use, reproduce, edit, and synchronize the Built‑in Sound Sets in Programs and Broadcasts created with the Service; and
  • Export, publish, distribute, perform, and monetize Programs/Broadcasts that incorporate the Built‑in Sound Sets (including via Catalog Publishing).

Restrictions (protect the assets, not your shows): (i) Do not resell, give away, or distribute the Built‑in Sound Sets as standalone audio or in any sound‑library/sample pack/template; (ii) Do not claim authorship, register claims, or assert Content ID against others for our original files; (iii) Do not use the Built‑in Sound Sets to train models intended to recreate or materially imitate the sets themselves. Attribution to “Radio Starlight Sound Sets” is appreciated but not required.

8.2 Other Sound Sets (User‑supplied / Third‑party)

You may connect or import other audio not provided by us. You are solely responsible for having the necessary rights (e.g., synchronization, performance, streaming) and for complying with any third‑party license terms.


9) Subscriptions (Pro) — Auto‑Renewable In‑App Purchase

  • Billing. Payment is charged to your Apple ID at purchase. The subscription auto‑renews unless canceled at least 24 hours before the end of the current period.
  • Manage / Cancel. Manage or cancel in Settings → [your name] → Subscriptions. Deleting the app does not cancel a subscription. If you cancel, service continues until the end of the current period.
  • Trials. If offered, trials convert to a paid subscription unless canceled before the trial ends.
  • Refunds. Apple handles refunds via Report a Problem; we do not issue direct refunds for App Store purchases.
  • Price changes. Subscription prices may change; Apple may notify you and, if applicable, your subscription continues at the new price unless you cancel.
  • Scope. Features available in Basic vs Pro may change over time; we may add, modify, or remove features.

10) Acceptable Use & Safety

You agree not to use the Service to violate laws or third‑party rights (including IP, privacy, and publicity), impersonate others, create deceptive endorsements, bypass technical limits, or upload/generate unlawful, harmful, or abusive content. We have zero tolerance for objectionable content or abusive users. In‑app tools are provided to report, filter, or block content and users. You may not use Service data or outputs to train foundation models except where expressly permitted.


11) Privacy

We process data as described in our Privacy Policy: https://radio-starlight.com/privacy_policy.html. Inputs/prompts and necessary context may be processed by the Model provider you select under that provider’s terms. On‑device generation (when selected and supported) occurs locally on compatible Apple hardware.


12) Open‑Source Components

The Service may include or interoperate with open‑source software governed by their own licenses, which control for those components.


13) Updates; Availability; Beta Features

We may update or change features (including Models or integrations) or discontinue the Service at any time. Some features require internet access and compatible hardware/software. We may offer beta/preview features that are experimental and may be suspended without notice.


14) Feedback

If you provide ideas or suggestions, you grant us a worldwide, royalty‑free, irrevocable license to use them without restriction.


15) Disclaimers

THE SERVICE AND ANY GENERATED OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, NON‑INFRINGING, OR FREE FROM OFFENSIVE CONTENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; YOU MAY HAVE RIGHTS THAT CANNOT BE WAIVED.


16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS/LICENSORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; YOU MAY HAVE RIGHTS THAT CANNOT BE WAIVED.


17) Indemnification

You will defend and indemnify us from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your User Content, Generated Output, publishing, or Sound Sets; (b) your use of third‑party sources/models; or (c) your breach of these Terms or applicable law.


18) Termination & Suspension

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, pose a security or legal risk, or if required by law or providers. Upon termination, rights granted to you under these Terms cease, except those that by nature survive (e.g., §§8, 9, 11, 15–22).


19) Changes to These Terms

We may update these Terms. The “Last Updated” date will change and, where required, we will provide additional notice. Your continued use after changes indicates acceptance.


20) Governing Law; Venue; Consumers

These Terms are governed by the laws of Japan, excluding conflict‑of‑laws rules. Exclusive venue lies in the courts located in Yamaguchi. If you are a consumer in a jurisdiction that requires a specific forum or grants non‑waivable consumer rights, these Terms will be applied to the fullest extent permitted without depriving you of those rights.


21) Export & Sanctions Compliance

You represent and warrant that you are not located in an embargoed country and are not on any government list of prohibited or restricted parties, and that you will comply with applicable export‑control and sanctions laws when using the Service.


22) Miscellaneous

  • Entire Agreement. These Terms (plus Apple’s Standard EULA, the Usage Rules, and our Privacy Policy) form the entire agreement regarding the Service and supersede prior or contemporaneous understandings on this subject.
  • Severability. If any provision is unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in effect.
  • Assignment. You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a merger, acquisition, or asset sale.
  • No Waiver. A failure to enforce a provision is not a waiver.
  • Headings. Headings are for convenience only and do not affect interpretation.
